An intra-company transferee is described as a business person who is employed by an enterprise and wishes to provide services to that enterprise, or its subsidiary or affiliate. These services must be provided in either a managerial or executive capacity or involve specialized knowledge.
Qualifications
To qualify as an intra-company transferee under NAFTA, the foreign worker must meet certain requirements.
The applicant needs to provide a letter or affidavit from his or her American or Mexican employer stating that he or she has been an employee for at least one year within the three year period immediately preceding the date of the application. This letter or affidavit must also provide a detailed explanation for the purpose and position that the entry to Canada is being applied for. Along with a number of other information that needs to be given in this letter or such as the intended duration of your stay, a comprehensive description of the relationship between the company in Canada and your employer in the United States or Mexico must be included.
Immigration Documents and Length of Stay
Intra-company transferees are not required to go through the job validation process but do need to obtain a work permit. The work permit received at port of entry has a time cap. Applications for an extension of a work permit must be submitted from within Canada.
The length of stay cannot exceed 7 years for a transferee employed in an executive or managerial capacity. Those intra-company transferees working in a specialized knowledge capacity can stay for a maximum of 5 years.
